Brown was arrested by police shortly after noon on Monday after they saw him talking on his cell phone behind the wheel and detected the odor of alcohol when they approached, TMZ reports.

Earlier Wednesday, Brown's attorney, Tiffany Feder, released a statement to TMZ pointing out that he has not been convicted of any crimes associated with the incident.

“Everyone is innocent until proven guilty and Mr. Brown was not driving erratically," Feder said. "He was speaking on his cell phone."

Brown, who recently was on tour with his reunited group New Edition, caused a stir at Houston's funeral in Newark, N.J. last month, when he left early over a seating dispute. According to accounts, Brown, who arrived with an entourage, was asked to move seats several times before eventually leaving the service altogether.
