FCC Chairman Julius Genachowski irked watchdog groups on Tuesday with his public endorsement of broadband caps during a major cable TV industry conference in Boston.

Under the cap concept, cable operators and other broadband service providers want to limit the amount of data -- including streaming video services -- that subscribers can access via their broadband services in a month, with the provider assessing extra charges for exceeding those limits.

NAB Challenging Constitutionality of FCC's New Political-Ad Rules

The National Association of Broadcasters is challenging the constitutionality of new FCC rules requiring local TV stations to put information about political advertising online, it said on Tuesday.

The new rules are “arbitrary, capricious, in excess of the commission’s statutory authority, inconsistent with the First Amendment, and otherwise not in accordance with the law,” the NAB said in a May 21 petition at the U.S. Court of Appeals for the District of Columbia.

In the documents the NAB filed with the court, the association did not spell out in detail its specific problems with the regulations adopted by the FCC April 27.

Music Industry's Crackdown on Illegal Downloaders Gets a Boost From Supreme Court

The music industry's attack on illegal music downloaders just got a big boost from the Supreme Court.

The court on Monday declined to review a $675,000 jury award against Boston University  student Joel Tenenbaum, who downloaded a mere 30 songs.

Tenenbaum had hoped to challenge the constitutionality of a 2009 jury award and the copyright law provisions at issue in the case.

The plaintiffs in the case were Sony BMG Music Entertainment, Warner Bros. Records, Arista Records LLC, Atlantic Recording Corp. and UMG Recordings.

The court’s refusal to intervene lets stand a decision by the U.S. Court of Appeals' 1st Circuit Court in Boston last year, which agreed that Tenebaum’s illegal...

Comcast Ups Data Usage Limits Following Netflix Complaint

Comcast Corp. announced Thursday that it is lifting its cap on customers' monthly bandwidth use in favor of a model that will enable subscribers to buy as much bandwidth as they want.

In a conference call with reporters, Comcast Executive Vice President David Cohen said the new policy -- which will increase bandwidth caps from 250 gigabytes a month to at least 300 gigabytes a month -- should address a complaint raised by Netflix that Comcast discriminates against the rental and streaming giant. Netflix's concern partly stemmed from Comcast's exemption of its XfinityTV app on Xbox from the bandwidth caps.

Netflix is turning up the heat on Comcast, Time Warner and AT&T over data caps that the cable companies place on unaffiliated streaming-video companies.

In its latest attempt to end what it considers discrimination on the parts of the three cable companies, the rental and streaming giant is "shopping questions related to data caps to the Senate Commerce Committee members in anticipation of tomorrow's oversight hearing with all five FCC commissioners," a person close to the situation told TheWrap on Tuesday.

Comcast, AT&T and TWC promote their own services by exempting them from the monthly broadband usage caps they apply to Netflix and other unaffiliated companies.
