California clothing company says pop singer may have branded herself one, but they’ve been using the label since ’97
So much for coining a hit song and phrase.
A California based clothing company is suing Madonna over her “Material Girl” clothing line.
Madonna may have immortalized the term with her 1985 chart topping single, but L.A. Triumph says it trademarked the phrase and has been using it on their junior’s apparel since 1997.
Madonna and her daughter Lourdes launched their own line of clothes earlier this month in partnership with Macy’s. Gossip Girl star Taylor Momsen was announced as the face of the brand.
L.A. Triumph has been selling clothes to similar retail stores such as Nordstrom at similar price points, attorneys for the clothing manufacturer wrote in the suit. The company further argues that Madonna’s higher profile and resources threaten to crowd out their own “Material Girl” line from the market.
L.A. Triumph is seeking exclusive rights to the brand name and any profits that the pop singer has earned from her own “Material Girl” products.
A spokesperson for Madonna did not respond to TheWrap’s request for comment.
