FCC Eliminates Law Preventing Cable Operators from Scrambling Basic Tier Digital Service

The agency originally put the prohibition into place in 1994 so subscribers with cable-ready TV sets would not have to buy or lease set-top decoder boxes to view basic-tier programming.

But the cable TV industry has been lobbying against the prohibition, arguing that it has made it harder for cable operators to prevent theft of cable’s basic-tier packages.

That’s the case because the FCC decision at issue -- allowing the agency’s so-called program access rules to expire -- included key protection in the fine print for access to cable’s regional sports networks.

The funding was secured through the Prioritizing Resources and Organization for Intellectual Property Act, signed in 2008, to curb copyright infringement.
Attorney General Eric Holder awarded the grants on Wednesday at a ceremony at Towson University in Maryland.

Called an “incentive auction process,” the FCC would ask the nation’s 1,783 stations to sell off their channels’ space in the broadcast spectrum -- and, in effect, stop broadcasting.
That space would then be auctioned off to wireless companies like AT&T and Verizon to meet the growing demand for channel space for smartphones and other wireless communications devices.

Participation in the plan is voluntary. Broadcasters who agree to sell their rights to their channels would get a share of the auction proceeds.
