Maybe Todd Sucherman should just stick to waving at the audience from now on.

Sucherman, the drummer for classic rockers Styx, has been hit with a lawsuit after allegedly hitting a fan with one of his drumsticks during a concert.

In her lawsuit, obtained by the Atlanta Journal-Constitution, Lori Frederick claims that she was attending a Styx concert in Atlanta in June 2015 when Sucherman “negligently” threw a drumstick in her face, “causing serious physical injuries.”

The suit claims that the drummer “breached the duty of care owed to Plaintiff by willfully and negligently throwing a drumstick into the audience without timely and proper warning to allow Plaintiff to fully protect herself from injury.”

As a result, the suit claims, Frederick has racked up medical bills to treat her injuries, and has experienced a loss of income.

She also claims that, as a result of the alleged injuries, she was unable to compete in the Peachtree Road Race, and that her clothes were ruined “due to Plaintiff’s bleeding.”

No word on whether the lawsuit also left Frederick with too much time on her hands.

Frederick is seeking unspecified damages in the lawsuit, which was filed in state court in Georgia.

TheWrap has reached out to Styx’s publicist for comment.
