United Talent Agency filed a breach of contract lawsuit against "American Pie" producer and writer Adam Herz in Los Angeles Superior Court on Tuesday, claiming that the movie scribe stiffed the agency out of its 10 percent commission on the upcoming "American Reunion," according to court papers obtained by TheWrap.
Herz served as writer and producer on all of the "American Pie" movies but was cut from the franchise with the upcoming "American Reunion" (aka, "American Pie 4").
UTA claims to have brokered a deal for Herz starting with "American Pie 3" (aka, 2003's "American Wedding") that "provided him with millions of dollars as well as a right of first negotiation on any subsequent sequels and remakes with a guaranteed compensation package."
According to UTA, because of that deal, Herz was given "millions of dollars" when Universal bounced him from "reunion," and Herz promptly "left UTA and blatantly disregarded his contractual obligation to pay the agency its commissions for 'American Pie 4.'"

Though the suit acknowledges that Herz's compensation for "American Pie 4" is "presently unknown," it goes on to say that that UTA "is informed and believes and based thereon alleges that Herz received financial compensation in an amount no less favorable than his compensation for 'American Pie 3.'"
According to UTA, Herz was given "in excess of $700,000" for his producer services on "American Wedding," plus "over $6 million in profit participation."
UTA is seeking damages "in an amount to [be] proven at trial, but in any event in an amount in excess of $700,000," plus the cost of trial and "pre-judgment interest at the maximum rate permitted by law."
Herz's attorney did not immediately return TheWrap's request for comment.
