Jared Fogle Loses Bid for Shorter Prison Sentence

Former Subway spokesman claimed that he was being unfairly punished for his fantasies

Sorry, Jared Fogle — your prison sentence isn’t losing any weight.

Disgraced former Subway spokesman Fogle has lost his appeal to have his prison sentence lessened, USA Today reported.

Fogle, who’s currently serving a 15-plus year prison sentence for conspiracy to receive child pornography and traveling to have sex with a minor, filed an appeal late last year. Fogle claimed that his sentence was excessive, and that he was being improperly punished for his fantasies.

However, on Thursday, a federal appeals court upheld the sentence handed down last year.

Last year, prosecutors agreed to seek no more than 12.5 years in the case, while Fogle’s team agreed to seek no less than five years. But in hearings in the appeal this year, prosecutors contended that the sentence he received was just.

According to court documents obtained by TheWrap, Fogle received multiple images of minors engaged in sex acts from Russell Taylor, the former executive director of his charitable foundation, and knew that those depicted were under 18. Taylor filmed the minors without their knowledge using a series of hidden cameras in his home. Some of those depicted were reportedly as young as six years old.

Fogle also traveled multiple times to New York with the purpose of engaging in a sex act with a minor. One victim was 16 when she had sex with Fogle in exchange for money. He also informed multiple prostitutes that he hired across several different states that he would provide a “finder’s fee” to anyone who could arrange for him to have sex with a minor.

In light of Fogle’s appeal, prosecutors filed papers noting that Fogle engaged in sex with two minors age 16 and 17, and sought to go younger in his communications with escorts.

Prosecutors also revealed a number of Fogle’s communications. In one communication, Fogle told a person,”I can pay you a little finder’s fee. I’ll pay you big for a 14- or 15-year old.”
