The last time I looked Emma Thompson was not the judge in this case and she doesn't know what’s going on. So why should we give a rats ass about what her opinion is.

I am more concerned about these clichés being flung around like Knives in the Water. Once we have said them we don’t have to bother to look at all the facts any longer. I mean people are using as a justification “A crime is a crime” to incarcerate Roman Polanski further.

But it was also a crime for a Santa Monica Judge to use illegal power to coerce Roman Polanski into waving his rights to dispute deportation 32 years ago.

The problem here is that clichés like "a crime is a crime" or "the law is the law", are enormous self-perpetuating techniques that we have all lost control of.

And really what does "the law is the law" mean in this case?

The movie Polanski: Wanted and Desired gives us a glimpse of the law, and does a good job to show that the law was jerking Roman Polanski around.
You will agree with what I just said, that the law was jerking Roman Polanski around, only if you believe that someone who has been charged with a crime should be treated fairly in all stages of the process, including the sentencing.

I don't think these clichés "The law is the law" or "A crime is a crime" is applicable in Polanski's case whether it was 32 years ago or now, as the Santa Monica Judge was going to renege on the plea bargain agreement when the agreement had already been made, and after Polanski had already served the non-appealable prison time specified in the plea bargain agreement

The plea bargain agreement had been formulated by the lawyers and prosecutors and victim's lawyer, and agreed upon so as to avoid a formal trial involving the 13 year old girl.

Once Polanski was informed that the plea agreement was going to be breached by the Judge from Polanski's perspective -the California Justice could no longer be trusted as Polanski had kept his end of the bargain by serving 42 days at Chino prison,

Note: Polanski would have served, and was willing to serve the full 90 days if Chino Prison officials had not released him after 42 days with no further prison time recommended by Chino Officials.

Judge Laurence J. Rittenband, wielded Illegal Judicial power to impose an indeterminate sentence on Polanski until he would agree to give up his RIGHTS to fight DEPORTATION.

The Santa Monica Judge's coercion of Polanski into involuntary deportation, using the threat of indeterminate prison time was in excess of the Judge's jurisdiction, and ILLEGAL.

Nikki - I don't think you're a liar. I actually saw that documentary you speak of last week and happen to agree with you on many points. I think people are getting confused because the charges he pled guilty to are not necessarily all of the charges that were brought forth due to a plea bargain (yes, sodomy and drugs were a part of it). These cases can be so complicated, and unfortunately the judge on that case did not have the victim's best interests at heart.

Anyway, you're one of the few people here making sense, and I know it's easy for folks to defend someone when it wasn't their child who had to suffer. No matter what this man had to endure in his life, it was wrong for him to do that to a child. All actions have concequences, even when you're a famous producer. Even some celebrities have begun withdrawing their support for him. Rape is rape, and I'm sorry, but a child cannot consent to sex let alone a drugged one. A good judge would have thrown him in prison at the first opportunity. I will never understand why some folks seem to thrive on blaming victims as if their attackers short-comings are somehow the victim's fault... Ridiculous. And some of these same folks would be first to cry out for justice had it been them who was raped or wronged.

In any case, the law is the law, and the reason the victim's pleas to let him go carry no weight is because he has already pled guilty and the case has already been made. The case is now out of her hands. Technically, Polanski was never sentenced. The time he served in the center for observation was not a prison sentence, his official sentence was to occur after being evaluated for 90 days. He only served roughly 30-40 days and fled once he realised he would probably get jail time at his sentencing.

If LA wishes to pursue these charges, I say good for them. There's no reason anyone should be allowed to get away with such awful behaviour, and all of us knows that if it was our son or daughter, we'd want justice. If Polanski doesn't want to go to jail, he should stop raping children (pedophilia).

My name is Samanthat Geimer. When I was 13 years old, I was the victim of unlawful intercourse by Roman Polanski for which he was indicted and pled guilty. I am writing to you about this and to comment upon Mr. Polanski’s post arrest conduct about which you may not know.

Had I been forced in 1977 to go through a trial which would have included the glare of T.V. lights and cameras, the crush of media in the hallways and the nationwide discussion of the events – it would have exacerbated, in the extreme, the harm which was caused to me by Mr. Polanski. Mr. Polanski at that time, plead guilty preventing the additional harm which the publicity of a trial would have caused.

At the time of his arrest my family and I consented and encouraged the then District Attorney, John Van de Kamp, to enter into a plea bargain with Mr. Polanski upon three conditions. That Mr. Polanski admit the conduct, show contrition, and seek assistance in changing his life. I believe that Mr. Polanski has done each of these. He has admitted the facts underlying the crime for which he has pled guilty. He has publicly expressed contrition, and Mr. Polanski has had a significant life change which merits consideration in connection with his attempted return to the United States. He is married and is a parent, as I am. He would like to put the events of March 10 1977 behind us, as would I. His contrition is sincere and the years have seemed to change his view towards the events and me. The events are almost a generation old. You will serve my interests by agreeing to allow Mr. Polanski to return to the United States on terms and conditions which are appropriate and consistent with the orignal plea agreement.

Although Mr. Polanski cannot undo the harm that was caused, it may yet be possible to limit the continuing intrusion this matter still brings to my life.
Each time Mr. Polanski is involved in a new movie, others wonder if he might come back to the United States. Those events and other curiosity about Mr. Polanski’s possible return causes a public “re-opening” of the case. That public re-opening of the case causes media reporters and photographers to engage in surveillance of myself and my family and causes me a great deal of distress. I believe with certainty that if Mr. Polanski is allowed to return and this case can be officially marked “closed”. The degree of publich scrutiny of myself and my family, although initially magnified, will begin to be diminished.

I have substantially recovered from the harm that Mr. Polanski caused me, and I have always felt that Mr. Polanski should be allowed to return to the US and resolve his legal problems without the threat of mor time spent in jail. I hope that this can now finally occur. For nearly 20 years this matter has clouded my future rather than been an isolated event in my past. At this point in my life I am prepared to face any intial publicity surrounding this matter. I ask you to begin the process by which the periodic surveillance and the threat of exposure I suffer may begin to be substantially diminished.

I request in the strongest possible terms that Mr. Polanski be allowed to come back to the United States, that the charges regarding his being a fugitive be dismissed, that the original plea bargain agreement be honred, and that he be allowed to remain in the United States upon the time served of his sentence

Dear Honorable Judge Fidler

I am writing you this letter as the victim of “unlawful sexual intercourse with a minor” for which Roman Polanski was convicted in 1977. It is my wish that you will include my opinions and feelings in your consideration of Mr. Polanski’s request to resolve his status as a fugitive and return to the United States without fear of arrest or incarceration. It has long been my personal opinion that he be allowed to do so. I think simply listing the reasons why might be the most clear and direct way to convey my feelings to you. First, let me say that I mean no disrespect to Judge Rittenband. However, I have always been very disappointed in the way he chose to handle this case.

Judge Rittenband was not acting on my behalf or in my best interest when he refused to allow te agreed upon plea bargain and settlement of this case which did not involve additional jail time for Mr. Polanski. It is also my opinion as the victim of this crime that the 42 days he has already served is excessive.

I believe if you review the facts, it is apparent that he was not being treated fairly, and you may understand why Mr. Polanski was frightened enough to flee the U.S. at that time. I do not believe he was fleeing justice, but fleeing the lack of it in this particular case. I urge you to use leniency when considering this aspect of his case.

The continued publicity surrounding this case has been so intense at times that it has changed my life forever from what it might have been. The fact that Mr. Polanski has not been allowed to resolve his legal problems perpetuates the interest in his situation an in me personally. Last month, a well known publication, with whom I refused to speack, published a lengthy article on Polanski. While I have suffered many an unkind word over the last 20 years, this article contained so many untruths about myself and my family that I have decided to give up my anonymity in order to respond in my own defense. The resolution of this case can finally bring to an end this unwanted interest in me.

I do not believe that it was Mr. Polanski’s intentions to frighten me or cause me harm. I am sure that he now understands why his actions were in fact inappropriate and damaging to me. I do not think that he is any danger or threat to the American public.

I have recovered from the events of March 10th 1977. I have moved on and am very happy with my life. I feel I can also recover from the traumatic effect of the continued publicity if this situation could only finally be resolved. I have long awaited the day athat this issue is put to rest once and for all, and I am hopeful that this time may be at hand.

According to the Daily Bulletin of California's Inland Empire — home of the Chino State Correctional Facility where Polanski was first incarcerated for the rape charges from December 1977 - January 1978.

The article discloses that while Polanski was serving his time he directed a training film about prison gangs for the Corrections Department. The Bulletin's writer describes the circumstances of the shoot:

Cameras rolled in the prison's East facility, the same one trashed in the recent riot. It was a lockup for high-security and protective-custody inmates. "Roman was a very diminutive and overwhelmed-by-prison inmate, but over in the East Facility cellblocks, with camera and lights rolling, he would `forget himself' and DIRECT, BABY, DIRECT!" cracks my source.

"He would shout out orders to some really heavy-duty gang characters - allowed out of cells only one at a time - to `stand this way' or `suck in that gut,' and all sorts of personal comments and commands. And the gang members, clearly STARSTRUCK by being on camera, meekly complied!

After spending a few hours a day working on the shoot, "the film was suppressed and never used for departmental training."

It is extremely exciting to imagine that somewhere out there, in a dark government archive, the Rosemary's Baby of prison guard training films sits waiting for its day in the California sun. Or maybe it is a prison guard & California version of the Fat and the Lean.

Roman Polanski met Sharon Tate while filming The Fearless Vampire Killers and began dating. In 1968

Roman Polanski went to Hollywood, where his reputation was enhanced by the success of the thriller Rosemary's Baby (1968).

On January 25, 1968,Roman Polanski married Sharon Tate in London, England.

On August 9, 1969, Sharon Tate, who was eight months pregnant, and four others (Abigail Folger, Jay Sebring, Wojciech Frykowski, and Steven Parent) were brutally murdered by members of Charles Manson's "Family", who entered the Roman Polanski home on Cielo Drive in the Hollywood Hills with the intent to "kill everyone there".

They knew that the previous owner of the house, record producer Terry Melcher, had moved out. He had failed to help Charles Manson's fledgling music career, which was thought to be a possible motive, but the murderers testified that they knew he no longer lived there.

When Manson told them to go to the property and kill everyone, they obeyed.

After Parent, Sebring, Frykowski, and Folger had been killed, Roman Polanski's wife the lovely Sharon Tate pleaded for the life of her unborn son. Susan Atkins replied that she had no mercy for her, and then killed her. She soaked up some of Tate's blood and wrote "PIG" on the front door using a towel.

The murders were unmotivated, and at first there were no suspects.

Roman Polanski, who was away on business, was initially considered a suspect by both the authorities and the press.

As the days passed, Roman Polanski became more and more the target of investigation by the Los Angeles County Sheriff's Office, until Manson and his "family" were arrested on unrelated charges, which revealed evidence of what came to be known as the Tate-La Bianca murders.

Distraught and heartbroken, and seriously rattled over his near-arrest for the murder of his wife and unborn child - Roman Polanski returned to Europe shortly after the Manson killers were arrested.

It seems that the Los Angeles County Prosecutors have unjustly wanted to arrest Polanski since 1969.

It also seems that the International press have been slanted against Polanski since the murder of his beautiful American wife and unborn child.

But Polanski cannot be blamed for the murder of his wife and unborn child - since he was filming in Europe, and just because he directed, Rosemary's Baby does not mean that he is the devil incarnate.

How could Roman Polanski murder his wife and unborn child if he was in Europe, and if the Manson teenage gal Susan Atkins admitted to the crime.

I mention this because Roman Polanski could be still on trial for the murder of Sharon Tate and his unborn child and the sexual assault rap at the time and 32 years later - might just be a pretext!!!!!

Look, I get that some of you like Polanski and don't want to see him serve anymore time, but what has this got to do with the facts of the case? I'm beginning to feel like I'm trying to explain the heavens to a group of baboons!

This Sunday HBO will air "Roman Polanski: Wanted/Desired" in Northern California. If you are not located in California, surely you will be able to obtain a copy of this documentary elsewhere. The facts are stated on this documentary quite plainly. Anyone who wishes to verify anything I've said, please feel free to watch this documentary and stop calling me a liar in an effort to shut me up.

Buck - Firstly, 42 days is NOT punishment for the rape and sodomy of a child. His sentence would have been a maximum of 25 years. He has hardly served anything and belongs where he is. Secondly, the place he was sent was not a prison. He was sent to a center for "evaluation" because it was the only place the judge could send him without the defense being able to appeal. The judge was indeed corrupt, but due to public outcry, decided he would have to sentence Polanski to jail time. When the defense realised this, they encouraged Polanski to flee. Prosecution did NOT encourage this and had nothing to do with it.

There is no reason for me to twist any of these facts. I don't know or care about Polanski, nor do I give a fiddler's fart about you. But if you are going to defend someone, have the sense to check your facts so you do not look like a complete moron to everyone on this site.

What Marshal says makes sense. "Yeah, like you wouldn't have fled had you been railroaded after you had pleaded guilty to underage sex, done your time, been released early, only to face decades more for a media hungry judge who was removed by both attorneys for misconduct. The discredited judge wanted to lock him up for ages and then deport him, which wasn't his call either. PS... PassingBy, Seth, and Meg - Exactly. It's nice to see some individuals with sense here, and I agree that I have yet to see an intelligent argument for why Polanski does not deserve to be punished. While I have enjoyed some of his films, it is clear that some of his films are a demonstration of what he would do to young girls (as stated by the prosecutor who worked on the case).

Some of you should watch the recent documentary about this man that explains the details of the case and how the procecutor was able to determine this jerk was guilty. The reason Polanski was able to plead guilty to a lesser charge is because the judge and procecutor wanted to avoid dragging the case out or having the victim testify. She was only 13 years old, and they didn't want anyone dragging her through the mud, nor did they want to ruin her chances for a normal life. They knew that if they went for a higher charge, Polanski would drag it out to avoid jail time and the victim would be dragged through the mud by all his celebrity friends.

The facts are out there, all you have to do is read them to see what a predator this man is. You can love the person, but do not confuse love for the person with love for all their actions. Polanski pled guilty to unlawful sex with a minor (pedophilia). Rape would have given him a sentence of 15-25 years. The charge he pled guilty to carried a sentence of probation - 20 years (judge's discretion at the time). He got away with 30 days in an observation centre and fled to France when he knew there would be jail time coming. DO YOUR HOMEWORK.

Also, keep in mind that the times have changed and the law books are a lot less tolerant of such nonsense, which is why I'm glad they're dragging his arse back here for proper punishment!

I would encourage all of you determined to defend a rapist to read the actual facts of the case as I did before posting.

The 13 year old girl was examined, and there was no doubt that sodomy had been committed. This is also in the police report. They also found drugs in her system. Polanski did NOT deny giving the girl drugs (a quaalude) and alcohol (champagne), proving my point that the girl was not in a state to give consent. Polanski also has a history of liking young girls. This is stated over and over again in a recent documentary about him, where his celebrity supporters at the time blame the victim's mother, asking, "why would she leave her daughter there knowing how wild he is and how much he loves young girls!". What sort of sick barstard asks that?

I would also like to point out that I was never a fan of Michael Jackson after the abuse accusations. But more relevant is the point that Michael Jackson and Roman Polanski are 2 separate individuals. Let's stay on point shall we?

A lot of people simply like Polanski and want him out of this. Their problem is that he IS guilty and a rational argument in favor of letting him off cannot be constructed. So they keep coming up with all manner of red herrings, simply cuz they got nothing real to use. I'm yet to read one intelligent post online making a good case in favor of this guy. He's just guilty, get over it already.

Indeed Nikki's 'facts' are incorrect. I really love it when people twist things. First of all, paedophilia? Not when having sex with an adolescent. Paedophiles are attracted to children and usually repeat offenders. Polanski was not, no matter how many want him to be. And don't come up with the nonsense that he slept with Kinski later. She was over the age of consent and certainly wasn't raped either. The fact of a major age gap between therm has no meaning either.

Just to remind you of the documented facts then: Polanski did NOT admit to drugging and giving her alcohol to HER OWN WORDS. And for your information, the girl was quite conscious and capable of giving consent and certainly wasn't 'knocked out' either. Huston found her quite compos mentis and unharmed and the girl never made any attempts of fleeing or fighting him. She could have escaped at any given time or screamed for help, especially with the door open and Huston being right there, yet waited for him to return to have sex again. The cops forced Huston to renege on that statement later or she'd faced cocaine possession charges. That doesn't make her testimony any less true at the time and only the cops more corrupt.

The original counts included rape by drugs, so was drugging and plying of alcohol. But findings didn't support any of that, and the deal was only struck for a lesser sentence of unlawful sex due to the attorneys having had no case of rape for the medical evidence not supporting any of her words. Her statement wasn't corroborated by witnesses and Polanski's own testimony where they mattered MOST, and all they could do was offer him the statutory rape charge. The fact that the judge then reneged on their plea bargain was just another glorious US justice move. No wonder he was removed by BOTH attorneys for illegal misconduct and discredited.

But of course you prefer to ignore the evidence and fact that she consented no matter she wasn't allowed to by law, and then later told porkies that couldn't be proven. They asked for him not to be imprisoned and Geimer often enough declared that it wasn't rape, because it wasn't. And don't try to convince us otherwise with your words of hoping this would never happen to our own children.

Los Angeles Prosecutors ignored Roman Polanski for 32 years because it was a terrible case in which the prosecutor's office and Judge Rittenband, in the interest of getting publicity for themselves, had conducted themselves in all variety of dubious ways. But recently a documentary, Roman Polanski: Wanted and Desired, came out detailing all this dubiousness.

So the only motivation for going after Polanski now, is not about sexual assault 32 years ago. These people couldn't give a damn about sexual assault

The motivation as it is so often is with prosecutors, is revenge—Polanski and this film makes the Los Angeles District Attorneys office and the County of Los Angeles Santa Monica Courthouse look bad by uncovering the staged hearings and the injustice against Polanski.

I don't know which is worse - the self centered Santa Monica Judge, and his illegal manouevers. Or the prosecutor who may or may not have lied in Polanski: Wanted and Desired.

Or the self satisfied, holier than thou people who distort the truth, and although imperfect themselves clamor for blood like Vampires

Or the online press that do a great disservice by leaving out details such as it was just a teenage girl Susan Atkins that murdered Polanski's American Family by stabbing them 18 times- thus twisting the truth of what this man has had to endure in America.

Nikki's details are a misrepresentation in that Polanski never admitted to SODOMY.

The young girl may have actually been attracted to Polanski. She probably never pondered on whether her attraction to Polanski was legal or not.

It is also possible that Samantha wanted the fame and money that being around Polanski would bring, and was frightened that if she was not intimate and Polanski no longer wanted to use her - her chance of STARDOM would be dashed, and mum would be mad.

Also why was Samantha a 13 year old so completely helpless and mesmerized?????? Why did she accept Champagne and a Quaalude from a stranger. You know what they say about strangers and chocolates!!!

As a father with two daughters, I must ask -- is there a difference between whether your daughter is raped by Roman Polanski or some hood walking down the street? For those of you with daughters of your own, probably not.

Polanski was found guilty and when he feared the possibility of a stronger sentence for his crime, he fled justice. He did not pay for his actions. He continues to believe that he should not be held accountable.

If Polanski goes free without facing the court to resolve the issue, what does that tell other would-be rapists?

Whether the sentence was appropriate or not, whether the judge at the time was right or wrong, if he would stop dragging this out he would be able to get the reconsideration of what transpired reviewed. But as long as he continues to remain a fugitive -- one who does not, by the way, dispute his guilt -- he does not deserve to have his case reviewed and revisited with the possibility of being let off with time served.

It is not the D.A.'s office that is dragging this case out. It is Polanski and his attorneys who continue to file motions to block his extradition and get him released. The reason the original victim and her family are still faced with this matter in their lives (and are being revictimized again) is because for over 30 years Polanski has admitted his guilt but has been too weak to face the penalty for his crime. It is Polanski who continues to victimize this woman, not the justice system.

Thankfully it's not up to this father or he would be getting stiff penalties for evading the law and costing the taxpayers so much money in a 30 year case that would have meant a few months or less of additional jail time. This is the man of character that his defenders try to protect.

Put yourself in the shoes of the parents and children of this country when you try to help a rapist justify his not being punished for his crime. Outrageous!

Much of the antagonism towards Polanski shifted early on from being people concerned with justice to frothy-mouthed conservative family-values types seeing an opportunity to lambast their ideological opponents in the culture wars.

Polanski should obviously be held accountable for both the crime and his subsequent flight, hardly anyone is denying that. Anyone who starts talking about "Hollywood-types" in reference to Polanski's guilt is clearly more concerned with dragging a public figure through the mud than seeking justice however.

This debate has brought out the worst in everyone.

Interesting that most if not all of the highly self-righteous and indignant comments about Polanski, are from those who know nothing or who were not around at the time of the actual incident – oh yes they may have read some of the second hand reports on the internet, but still for the most part they know little of what really happened – I know, because I was around at the time and knew some of those involved.

Basically, the police had nothing to go on other than the girl’s statement and to prove such a case during those days without obtaining DNA etc would be nigh impossible.

They needed some sort of corroborating evidence. This they obtained through Anjelica Huston, who was arrested at Jack Nicholson’s house (where she was staying at the time) with a gram of coke (in those days, very bad for one’s career as far as the studios were concerned) and promptly had the charges dropped after being persuaded by police and her agent into agreeing to testify that she saw Geimer naked in the presents of an adult male, namely Polanski. Thereby, under California Law and without even physically touching anyone, this would constitute outright “Statutory Rape”

Nevertheless, “Statutory Rape” would definitely suffice in this situation for the sake of a high profile, money making prosecution and court case – everyone would get a little taste of something to take home – including the arrogant Judge, who later, when realizing how much notoriety was at stake, decided to reneged on Polanski’s previously agreed plea bargain of “unlawful sex with a minor” - for which Polanski spent an agreed upon time in jail undergoing what turned out to be a positive psychiatric evaluation.

Polanski never admitted to sodomizing Geimer or plying her with drink and drugs, as so many would have one believe - besides, that was not his preference nor his style.

Did Polanski like and sexually chase after young girls? Definitely not. S Polanski was to my knowledge and still is, far too decent and conservative in his personal ways and values to engage in such benign pursuits.

For Polanski, In film making terms, Sharon was the only scene ever worth printing and the memory which he would never re-cut or violate.

For years the Swiss have been happy to collect taxes from Polanski and capitalize Gstaad’s tourist industry on his residential celebrity –

How would they like it if the victim was their child, their sister, cousin, niece . . .? There are not two or three kinds of justice and it is time for Roman Polanski to face up to the charges and accept justice.

People seem to forget this isn't about some miscarriage of justice, where he was railroaded with a guilty plea in absentia. It's the FACT that he pled GUILTY to the charges and fled the country. There is no expiration date when you flee the country from your sentencing date. He could have done the time, had no down side to his career, and I would argue would have been more successful after his release date.
The losers that make the argument that the victim doesn't want him prosecuted is irrelevant. A prosecutor will go after anyone they feel the have a case with, regardless of witness and/or victim testimony.
